1. Agreement to These Terms
These Terms of Use ("Terms") govern your use of the Rocket Boost mobile application (the "App"). By downloading, accessing, or using the App, you agree to these Terms.
The App is provided by Jonathan Tran, trading as Rocket Boost Learning ("we", "us", or "our").
If you do not agree to these Terms, do not use the App.
2. Intended Users
Rocket Boost is an educational app intended for children, generally aged 7 to 11, with parent, guardian, school, or teacher oversight where appropriate.
If you are a parent, guardian, teacher, or other responsible adult allowing a child to use the App, you are responsible for supervising that use and ensuring that the use complies with these Terms.
3. Licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App for personal, non-commercial educational use on Apple-branded devices that you own or control, subject also to the Apple Media Services Terms and Conditions and any App Store usage rules.
No ownership rights in the App are transferred to you.
4. App Store Terms
If you download the App through the Apple App Store:
- your purchase, download, and any refund rights may also be subject to Apple's terms and policies;
- Apple is not responsible for the App or its content except to the extent required by applicable law;
- any claims relating to payment processing through the App Store should be directed to Apple where applicable.
5. User Profiles and Local Data
The App allows local user profiles to be created on the device using in-app usernames. These profiles are intended only to support progress tracking and app functionality on that device.
You agree not to use the App in a way that is unlawful, misleading, abusive, or intended to interfere with the App's operation.
6. Read Aloud and Device Features
The App may provide an optional Read Aloud feature using Apple's system speech-synthesis technology. Its availability and the voices offered may vary by device, operating-system version, language, and device settings. Read Aloud is provided to support learning and accessibility; it is not a guarantee that speech output will always be available or error-free.
The App does not record voice or access the microphone for this feature. Apple may manage system voices and voice downloads under its own terms and privacy policies.
7. Acceptable Use
You must not:
- use the App for any unlawful purpose;
- attempt to copy, modify, reverse engineer, decompile, or extract source code from the App except where applicable law expressly permits it;
- interfere with the App, its security, or other users' enjoyment of it;
- remove or alter any copyright, trademark, or proprietary notices.
8. Educational Content
Rocket Boost is provided for educational practice and general learning support. It is not a substitute for professional educational, teaching, or specialist advice, and we do not guarantee any particular learning outcome, score improvement, or academic result.
9. Question Issue Reports and External Services
The App may allow a person to voluntarily report a possible issue with a question by selecting a report category. The report feature is provided to help us improve educational content. It is not a customer-support channel, and we do not promise a response, correction, or particular outcome.
Reports are protected by Firebase App Check and may be rejected where security checks fail. The App uses Google Firebase for this feature and for crash diagnostics. Use of those services is described in the Privacy Policy. You must not attempt to misuse, automate, bypass, overload, or interfere with these services or the App's security controls.
10. Pricing and Payments
Rocket Boost is intended to be offered as a one-time paid app.
Any prices shown in the App Store, purchase flows, taxes, billing, refunds, and other transaction matters are handled under Apple's App Store systems and policies where applicable.
11. Intellectual Property
The App, including its design, text, graphics, educational content, software, branding, and other materials, is owned by or licensed to us and is protected by intellectual property laws.
Except for the limited licence granted in these Terms, you do not receive any right, title, or interest in or to the App.
12. Disclaimer
To the maximum extent permitted by law, the App is provided "as is" and "as available" without any express or implied warranties.
Nothing in these Terms excludes or limits any rights you have under consumer law that cannot lawfully be excluded or limited.
13. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive loss or damage arising from or related to the use of, or inability to use, the App.
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot lawfully be excluded or limited under applicable law.
14. Suspension, Updates, and Availability
We may update, modify, suspend, or discontinue the App or any part of it at any time. We do not guarantee that the App will always be available, error-free, or compatible with every device or operating system version.
15. Changes to These Terms
We may change these Terms from time to time. If we do, we will update the "Last updated" date above. Continued use of the App after updated Terms take effect means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of England and Wales.
If you are a consumer living outside England and Wales, you may also benefit from any mandatory provisions of the law of the country where you live.
The courts of England and Wales will have non-exclusive jurisdiction over disputes relating to these Terms, which means you may also be able to bring a claim in your home jurisdiction where applicable law allows.
